How to complain about how we handle your information

If you think we have got something wrong with your personal information, you can complain to us. This page tells you how, what we will do, and what to do if our answer does not satisfy you.
Who can complain
Anyone whose personal information we hold. That includes patients, now or in the past, and people who only ever made an enquiry. It includes anyone who works or has worked for us. And it includes anyone else whose details reach us, such as someone named as an emergency contact.
You can complain for someone else — a parent for a child, or someone acting under a power of attorney. We will usually ask for something that shows you may act for them. A child old enough to understand what they are asking can complain themselves, and we will answer in language they can follow.
What you can complain about
Anything to do with your personal information that you think we have got wrong. You do not need to know the law, quote it, or use the words "data protection". For example:
You think we hold something about you that is wrong or out of date.
You think we shared your information with someone we should not have.
You think someone here looked at your records without good reason.
You asked for a copy of your information and did not get it, or it took too long.
Your information was lost, or sent to the wrong person.
If you are not sure it counts, send it anyway. It costs you nothing. We will work out which process it belongs in and tell you.
How to complain
There is no form you have to use, no wording you have to get right, and no fee.
By email. hello@unityhealthperformance.com. Put "Data protection complaint" in the subject line if you can. If you forget, it still counts.
By phone. 01376 310915. Tell whoever answers.
In person. Tell any member of our team, at either clinic. They will write it down for you, give you a copy of what they have written, and pass it on the same day.

If writing is difficult for you, for any reason, tell us. We will take the complaint down over the phone or in person and read it back to you. If you need this page or our reply in large print, or in another format, ask and we will provide it.
You do not have to complain to the person your complaint is about. If it is easier to raise it with someone else here, do that.
What we will do, and when
Within 5 working days we will acknowledge your complaint in writing, saying what we understand it to be and who is dealing with it. The law allows us 30 days for this; we do not intend to use them.
Straight away we will start looking into it — the records, the people involved, and what actually happened.
At least every 4 weeks we will keep you posted if it is taking a while.
Within 30 days of receiving your complaint we will write to you with our answer. If something genuinely cannot be done in that time, we will tell you why and give you a date, and it will be no later than 45 days.
Our answer will say plainly whether we think you were right. If we got something wrong, we will say so, tell you what we have done about it, and what we have changed so it does not happen again. If we disagree with you, we will explain why, in terms you can check.
If you are not happy: the Information Commissioner's Office
The ICO is the UK's independent data protection regulator. It is free to use, it is independent of us, and it has powers we cannot influence.
You can go to the ICO at any time. You do not need to complain to us first. You do not need to wait for our answer. You do not need our permission, and you do not need to tell us you have done it.
Two things are worth knowing. The ICO will usually ask whether you raised the matter with us and what we said, and will usually want us to have had a reasonable period — around 45 days — to reply. It also asks people to come to it within three months of their last contact with the organisation, so try not to leave it too long. Neither is a rule we set, and neither stops you contacting the ICO today.

You can also bring a claim in court, including for compensation, if you have suffered damage or distress. That right is separate from complaining to us or to the ICO, and you can use it whether or not you do either.
If your complaint is about the Director
Unity is a small business. The Director owns it, runs it, and is our data protection contact. So if your complaint is about a decision they made about your information, the person who would normally answer it is the person you are complaining about. We do not have an independent panel, and we are not going to invent one.
Here is what happens instead.
Send it to our Clinical Director at jessica@unityhealthperformance.com. She will record it, look into it, and write the answer.
She reads that inbox, but it sits on the clinic's email system, which the Director administers. If you need to be certain they cannot see your complaint, contact the ICO instead. Their details are above.
The law still requires the business to answer you, so you will still get a written answer within the times set out above. It will tell you who wrote it, and that they are not independent of Unity.
We will put the ICO's details at the top of that answer, not at the bottom.
